Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Tech Help Local ("we," "us," "our"). By booking a service, opening an account, or using our website, mobile experiences, or APIs, you agree to these Terms. If you do not agree, do not use the service.

1. The service

Tech Help Local connects households and small businesses with vetted local technicians for in-home and on-site technology services — Wi-Fi, smart-home, security cameras, AV, small-business IT, and related categories. We schedule the visit, dispatch the technician, perform the work, and stand behind it under the guarantee in §3.

2. Pricing, quotes, and payment

  • Published pricing on our website is a baseline. The technician will confirm a final price in writing before any work begins.
  • Written quotes are valid for seven (7) days from the date issued unless we say otherwise.
  • Payment is processed through Stripe. We accept major credit cards and ACH where supported.
  • You authorize us to charge the payment method on file once a service has been performed and accepted.
  • If a payment fails, we may pause future appointments until the balance is resolved. We do not charge late fees on individual residential tickets.
  • Trip charges, parking, materials, and any third-party hardware you ask us to source are itemized separately.

3. The 30-day fix guarantee

If a problem we fixed comes back within 30 days of the original appointment, and the same conditions still apply (no replaced equipment, no material change in your network, no third-party tampering), we will return at no additional labor charge to make it right. The guarantee covers the specific problem we addressed; it does not cover unrelated tech issues that surface afterward, third-party hardware failures, or damage caused by power events, weather, or other external causes.

If we cannot resolve the recurrence on the return visit, you may choose between a full refund of the labor portion of the original invoice or credit toward a replacement service. This is your sole and exclusive remedy under the guarantee.

4. Cancellations and rescheduling

  • You may reschedule or cancel a booking up to two (2) hours before the start of the appointment window with no charge.
  • Cancellations inside two hours, and "no answer at door" arrivals, may incur the trip charge listed at booking.
  • If we cancel or are materially late through our fault, the visit is free.

5. Your responsibilities

  • You confirm that you are at least 18 years old and have authority to permit work at the address provided.
  • You will provide reasonable access, working power, and a safe environment for the technician.
  • You will back up critical data before any work that could affect a device, and you accept responsibility for the integrity of that backup. We will not work on systems that are missing a current backup if data loss is a foreseeable risk.
  • You will not ask the technician to perform work that violates applicable law, building codes, or the manufacturer's warranty on equipment you do not own.
  • You will treat our staff with respect. We may decline or terminate a visit if a technician feels unsafe, and a trip charge may apply.

6. Third-party hardware and software

We frequently install, configure, or troubleshoot equipment manufactured or software developed by third parties. We do not warrant the underlying hardware or software, and any manufacturer warranties run directly between you and the manufacturer. If equipment we sell to you fails inside the manufacturer's warranty window, we will help facilitate a replacement on a reasonable-effort basis.

7. Account, security, and acceptable use

Some features (the customer portal, AI Concierge with full account context) require an account. You are responsible for keeping your credentials secure. Notify us immediately at security@techhelplocal.com if you suspect unauthorized access.

You agree not to:

  • Use the service to harass, defraud, or harm others.
  • Probe, scan, or otherwise attempt to compromise our infrastructure or that of any other user.
  • Submit content that is unlawful, infringing, or designed to abuse our AI assistant or staff.
  • Resell or rebrand our services without a written reseller agreement.

We may suspend or terminate access at any time for material breach of these Terms. We will refund any prepaid amounts for services not yet performed.

8. Intellectual property

The site, brand, content, and software are owned by Tech Help Local or our licensors. You receive a limited, non-exclusive, non-transferable license to use the service for your own household or business operations. Configuration notes and documentation we leave with you after a visit are yours to use; the underlying templates and tooling remain ours.

9. Disclaimers

Except as expressly stated in §3, the service is provided "as is" and "as available" without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website or APIs will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service in any twelve-month period will not exceed the greater of (a) the fees you paid to us for the specific service that gave rise to the claim, or (b) one hundred U.S. dollars (US$100). We will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, loss of data, loss of profits, or business interruption, even if advised of the possibility of such damages.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to indemnify and hold Tech Help Local, its officers, employees, and contractors harmless from any claim arising from (a) your breach of these Terms, (b) your misuse of the service, or (c) your violation of any law or third-party right in connection with the service.

12. Governing law

These Terms are governed by the laws of the State of [STATE — placeholder pending owner decision], without regard to its conflict-of-laws rules. Subject to §13 (arbitration), any action permitted in court will be brought exclusively in the state or federal courts located in that state, and you consent to personal jurisdiction there.

13. Dispute resolution and arbitration

Until this section is finalized, you and Tech Help Local each retain all rights otherwise available under applicable law, and nothing in these Terms is intended to waive any non-waivable rights.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date and, where required by law, notify account-holders by email. Continued use of the service after the effective date of an update constitutes acceptance.

15. Miscellaneous

  • Entire agreement. These Terms, plus the Privacy Policy and any signed work order, are the entire agreement between you and us.
  • No assignment. You may not assign these Terms without our written consent. We may assign in connection with a sale of the business.
  • Severability. If any provision is found unenforceable, the remaining provisions stay in force.
  • No waiver. Our failure to enforce a provision is not a waiver.
  • Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
